Welcome to Capital Kidz. These Terms of Use ("Terms") are a legal agreement between you and Capital Kidz ("Capital Kidz," "we," "us," or "our") and govern your use of www.capitalkidz.com (the "Site") and any purchase you make from us. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old (or have the involvement of a parent or guardian) to make a purchase. By using the Site, you represent that the information you provide is accurate and that you are legally able to enter into this agreement.

2. Your Account

If you create an account, you are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly at service@capitalkidz.com of any unauthorized use.

3. Products, Pricing, and Availability

  • We strive to display products, colors, and prices accurately, but we do not warrant that descriptions, images, or other content are error-free.
  • All prices are in U.S. dollars and may change at any time without notice.
  • Products are subject to availability, and we may limit quantities or discontinue items.
  • If a product is listed at an incorrect price or with incorrect information, we reserve the right to cancel or refuse any order, even after it has been confirmed. If we cancel an order after you have been charged, we will issue a refund.

4. Orders and Payment

Your order is an offer to buy. We may accept or decline it for any lawful reason, including suspected fraud or pricing errors. Payment is processed by third-party payment providers through Shopify; by placing an order, you authorize us (and them) to charge your selected payment method for the total amount, including taxes and shipping.

5. Shipping, Returns, and Refunds

6. Promotions and Discount Codes

Discounts, coupons, and promotions are subject to their stated terms, cannot be combined unless stated, have no cash value, and may be modified or ended at any time.

7. Email and Text Communications

By providing your email or phone number and opting in, you consent to receive transactional and (where you have opted in) marketing messages. Marketing consent is not a condition of purchase.

  • Email: you can unsubscribe at any time using the link in any marketing email.
  • Text messages (SMS/MMS): message frequency varies and message and data rates may apply. Reply STOP to cancel or HELP for help at any time. We do not sell or share your mobile opt-in information with third parties for their own marketing.

8. Intellectual Property

The Site and its content — logos, text, graphics, images, and design — are owned by or licensed to Capital Kidz and protected by intellectual-property laws. You may not copy, reproduce, or use our content or trademarks without our written permission.

9. Reviews and User Content

If you submit reviews, photos, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and publish that content in any medium in connection with our business. You are responsible for your content and agree it is accurate, lawful, and not infringing or offensive.

10. Acceptable Use

You agree not to use the Site, or allow anyone else to use it, for any unlawful or prohibited purpose. Specifically, you agree not to:

  • Use the Site for any unlawful purpose or to solicit others to perform unlawful acts
  • Violate any international, federal, state, or local laws, rules, or regulations
  • Infringe upon or violate our intellectual-property rights or the rights of others
  • Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
  • Submit false or misleading information
  • Upload or transmit viruses or any other type of malicious code
  • Collect or track the personal information of others
  • Spam, phish, pharm, pretext, spider, crawl, or scrape
  • Use the Site for any obscene or immoral purpose
  • Interfere with or circumvent the security features of the Site or any related website
  • Attempt to gain unauthorized access to the Site, other accounts, or our systems

We may terminate your use of the Site for violating any of these prohibited uses.

11. Third-Party Links

The Site may link to third-party websites or services. We are not responsible for their content, products, or privacy practices, and accessing them is at your own risk.

12. Product Safety, Recalls, and Assumption of Risk

We sell juvenile and baby products (such as car seats, strollers, and nursery items). You are responsible for reading and following all manufacturer instructions, age and weight guidelines, warnings, and installation directions that come with each product. Product warranties, where offered, are provided by the manufacturer, not by Capital Kidz. If a product you purchased is subject to a manufacturer or government recall, follow the remedy provided by the manufacturer or the U.S. Consumer Product Safety Commission (CPSC); we will share recall information we receive where reasonably practicable. To the fullest extent permitted by law, you assume the risks associated with the selection, installation, and use of the products you purchase.

13. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee the Site will be uninterrupted, secure, or error-free. Manufacturer warranties on products, where offered, are separate and provided by the manufacturer.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CAPITAL KIDZ AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, ARISING FROM YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

15. Indemnification

You agree to indemnify and hold harmless Capital Kidz from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of the Site or violation of these Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Montgomery County, Maryland, and you consent to their jurisdiction.

17. Changes to These Terms

We may update these Terms at any time. Changes take effect when posted, shown by the "Last updated" date above. Your continued use of the Site means you accept the updated Terms.

18. General

If any provision is found unenforceable, the rest remains in effect. These Terms, together with our Privacy Policy and other posted policies, are the entire agreement between you and Capital Kidz.
